Terms and Conditions

PurposeThese general terms and conditions define the terms and conditions of services provided by KromeWork SAS (hereinafter "the Service Provider") to its clients (hereinafter "the Client").

Services ProvidedThe Service Provider offers IT services including, but not limited to: IT systems consulting, maintenance, technical support, system design and configuration, and software development. The services are defined in a quotation or a specific contract, which can only be modified with the agreement of both parties.

Pricing and PaymentThe prices are indicated in the quotation or contract and are expressed in euros, excluding taxes. Payment is made according to the agreed terms, by bank transfer or any other accepted means. Any late payment will result in penalties in accordance with applicable law.

Service Provider's CommitmentsThe Service Provider undertakes to provide the services with diligence and professionalism. However, it cannot be held responsible for interruptions or malfunctions due to causes beyond its control (hardware failure, cyberattacks, force majeure, etc.).

Client’s ObligationsThe Client undertakes to provide all necessary information and access required for the performance of the services. The Client is responsible for the use of the services and the protection of their own data.

Liability and WarrantyThe Service Provider is bound by an obligation of means and not of results. It cannot be held liable for direct or indirect damages related to the use of the services. Any claim must be submitted in writing within 30 days after the service has been provided, either by mail to the registered office at 60 Rue François 1er, 75008 Paris, France, or by email to contact@kromework.com.

ConfidentialityBoth parties agree to maintain the confidentiality of any information exchanged in the course of providing the service.

Duration and TerminationThe contract is concluded for the duration specified in the quotation or contract. It may be terminated in the event of a serious breach by either party, after a formal notice remains unaddressed.

Applicable Law and DisputesThese terms and conditions are governed by French law. Any disputes shall be submitted to the competent jurisdiction of the Service Provider’s registered office.

Acceptance of TermsAny service order implies unconditional acceptance of these general terms and conditions.
